§395.8Driver'srecordofdutystatus.(a)(1)Exceptforaprivatemotorcarrierofpassengers(nonbusiness),asdefinedin§390.5ofthissubchapter,amotorcarriersubjecttotherequirementsofthispartmustrequireeachdriverusedbythemotorcarriertorecordthedriver'sdutystatusforeach24-hourperiodusingthemethodprescribedinparagraphs(a)(1)(i)through(iv)ofthissection,asapplicable.

(i)  Subjecttoparagraphs(a)(1)(ii)and(iii)ofthissecDon,amotorcarrieroperaDngcommercialmotorvehiclesmustinstallandrequireeachofitsdriverstouseanELDtorecordthedriver'sdutystatusinaccordancewithsubpartBofthispartnolaterthanDecember18,2017.

(ii)  AmotorcarrierthatinstallsandrequiresadrivertouseanautomaDcon-boardrecordingdeviceinaccordancewith§395.15beforeDecember18,2017mayconDnuetousethecompliantautomaDcon-boardrecordingdevicenolaterthanDecember16,2019.

Medical Examiner certified and listed on the National Registry �  January 30, 2015 to June 21, 2018, driver submits to the state

and carries a copy for 15 days. �  June 22, 2018, driver no longer needs to carry a copy once the

driver passes the medical exam. Medical examiner will upload to FMCSA who will notify the state.
