NFL Ruling of Deflate Gate
Judge Berman’s September 3, 2015 ruling on Deflate gate case
took away Tom Brady’s 4 games suspension on the grounds that:
• No testimony was provided from the NFL General Council (Jeff Paschu)
• Tom Brady was not given notice of discipline from NFL
• NFL didn’t share investigative evidence with Tom Brady’s lawyers
Decided based on NFL’s lack of compliance with HR legal
guidelines. Centered on due process not guilt vs. innocence.
NFLPA & Goodell
NFLPA (players association) stated after ruling that NFL collective
bargaining is a much better process, and CBA does not grant the
commissioner authority to be unfair.
Commissioner Goodell is appealing Berman’s ruling in an effort to
uphold the CBA and the integrity of the game. He wants to set his own
precedence about
• NFL disciplining players from within
• Following the integrity of the game
Facts Don’t Match Up
• NFL does not follow the law to provide players with notice of
discipline.
If the NFL does not comply with legal HR standards is it fair?
• NFL expects players to be responsible and accountable for their
behavior legally, ethically and morally.
How often do employees rise to higher standards than modeled by
management of their organization?
NFL Policies Tweaked
NFL policies improved
• Testing
• Recording
• Removal of footballs at halftime of random games this season.
Two officials designated
• “To conduct a pregame inspection to make sure all footballs meet the
required specifications.”
• Number all 24 balls
• Take and record a PSI measurement of every ball
• Legal range of pressure in NFL footballs is 12.5 PSI to 13.5 PSI
NFL & Expectancy Theory
• NFL Models a culture of “Win at Almost any Cost”
• Performance measures centered around won games,
not integrity in following rules
• Expectancy Theory Functioning beautifully for winning
games
• Players find winning games attractive – valance
• Strong link between effort and performance – expectancy
• Strong link between performance and reward – instrumentality

entertainment in the world, and to do so in a way that is consistent with our
values.

society and assumes the trust, character, and responsibility that comes with
that role.

We celebrate diverse opinions and perspectives. We honor hard work and
commitment. Every contribution makes us better.
IntegrityWe always look to make the right call.
We do the right thing when no one is looking, And even if it’s unpopular when
they are looking. We demand accountability and we expect fair play. We accept
responsibility when we get things wrong and then work to make them right.
NFL Values
Responsibility to Team
As a team, we support one another. We depend on one another.
Our fans give us their hearts. Our communities see themselves in us and we
see ourselves in them. Everything we do has a consequence for someone else.
We humbly strive to make our teams, our players, our fans, and our
communities proud and better.
Resiliency
We set high standards, and continuously strive for excellence.
We turn losses into lessons. We adapt to changing circumstances and lead in
new contexts. We embrace the greatest challenges and rise to meet them.
What Brings Down Team Morale
• Coaches not caring for players
• No trust between players or coach
• Players lack commitment
• Avoidance of Accountability
• Heavy workloads on stress, with no reward
or gratitude
• Losing Games
Team Culture
The culture is grounded in an identified sense of
mission and shared goals.
A team culture built on positive energy, support and
fun will…
• Lift everyone up on the team
• Feel comfortable
• And produce results
Creating Team Culture
• Coaches need to take an active role in the creating
of team culture.
• Through their leadership the team can identify
values, attitudes, and beliefs that will act as the
foundation for their personalized culture.
Important Questions to Ask
• What values do we want to act as the foundation for our
team culture?
• What are the goals that the team wants to pursue?
• How do the athletes and coaches want to treat each other?
• What kind of atmosphere do we want on the team?
Building Positive and High Performance
• Team Culture determines the team’s
• Fun
• Mastery
• Success
• Individual accomplishments
NFL Drafts

eligible college players to play for them

Prior to the Draft
Draft Advisory Board Decisions

makes predictions about the likely round a player would be drafted
NFL Scouting Combine
A six day assessment of skills in which college football players
perform tests in front of NFL coaches, general managers, and
scouts.
• Physical Test
• IQ Test
• Personality Test
What HR Should Learn from NFL
• Focus on demonstrated capabilities associated with success
• The managers work closely with players to help them develop
their skills and play at the highest level
• HEAVY emphasis on recognizing and rewarding the best
performers
• Different positions requiring distinctly different skills and
abilities
• Winning is a TEAM accomplishment
• Teams recognize the need for job or position specific
skills
• Pro teams have an average of 15 to 18 coaches
• Player evaluation is a very important part of training
• Ratings are linked to tangible and intangible rewards
What HR Should Learn from NFL
Result
Professional sports leagues are a great representation of effective performance management
Through Tom Brady’s case, the NFL culture shows through repeatedly as arrogance and status
trump player’s integrity and accountability
Performance = Winning, not cheating. NFL should address the cheating culture immediately
When organization culture aligns with its mission and values, it can assist employees in making
sense of their behaviors by providing justification for behaviors
A positive team culture and morale can help maximize team performance
