68 acuíferos en 24 países del continente americano:
o 17 en América del Norte,
o 4 en el Caribe,
o 18 en América Central y
o 29 en América del Sur
Durante el lapso 2003-2013, el grupo ISARM-Américas (Internationally Shared Aquifer ResourcesManagenment) ha trabajado integrando y analizando información sobre los acuíferos transfronterizos seleccionados por los países que los comparten, y desarrollando una metodología de análisis para su evaluación, para la prevención de conflictos.
Through the years 2003-2013, and in order to prevent conflicts, the ISARM-Americas group has worked integrating and analyzing information of transboundary aquifers selected by the countries that share them, and developing a methodology of analysis for their evaluation.

Por su clima seco, la faja fronteriza
México-EUA es la más problemática del
continente americano por la escasez
natural de agua. Esto provoca un uso
competitivo entre ambos países y entre
los usuarios de cada uno de ellos, lo cual
tiene como resultado efectos
transfronterizos negativos y complicados
problemas de manejo.
Due to its dry climate and natural scarcity
of water, the US-Mexico border strip is the
most problematic in the American
continent. These characteristics of the
land cause a competitive use of water
between both countries and between
the consumers in each of them, which
results in negative transboundary effects
and complicated handling problems.

El recurso hídrico más importante es el
agua subterránea.
Los acuíferos son reservorios estratégicos
en la seguridad hídrica de la frontera
compartida (G. Hatch, 2017).
Los acuíferos deben verse como la mejor
forma de conservar el agua.
Es importante considerar que la
administración binacional de los recursos
hídricos subterráneos, debe partir del
concepto de GOBERNANZA DEL AGUA.
La administración y uso conjunto es la
única forma de garantizar la continuidad
del agua subterránea.

The most important water resource is
groundwater.
The aquifers are strategic reservoirs in the
water security of the shared border (G. Hatch,
2017).
Aquifers should be seen as the best way to
conserve water.
It is important to consider that the binational
administration of groundwater resources must
start from the concept of WATER
GOVERNANCE.
Joint administration and use is the only way to
guarantee the continuity of groundwater.

En la GOBERNANZA del agua se requiere contar con un MARCO LEGAL ADECUADO.
Actualmente no existe una figura legal que permita estudiar todos los acuíferos transfronterizos y se tienen procesos y mecanismos institucionales muy diferentes en cada país.
Se deben plantear las bases legales para el trabajo conjunto en todos los acuíferos transfronterizos.
La información resultante debe ser pública y constituir la base para la planificación y el desarrollo.
Se debe evitar que en uno y otro lado de la frontera las actividades potencialmente contaminantes disminuyan la posibilidad de usar el agua subterránea.
La política hídrica debe ser soberana pero interdependiente.
Se debe fomentar la cooperación en la distribución equitativa de las aguas transfronterizas (G. Hatch, 2017).

In water governance, an adequate legal framework is required.
At present, there is no legal figure that allows the study of all the transboundary aquifers. The management and institutional administration widely varies from country to country.
The legal framework for joint work in all transboundary aquifers must be established.
The resulting information must be public and constitute the basis for planning and development.
Potentially polluting activities that reduce the ability to use groundwater should be avoided on both sides of the border.
Water policy must be sovereign but interdependent.
Cooperation in the equitable distribution of transboundary waters should be encouraged (G. Hatch, 2017).

La GOBERNANZA del agua requiere tener un profundo CONOCIMIENTO DE LOS ACUÍFEROS TRANSFRONTERIZOS y su difusión para crear conciencia.
Esto implica formar grupos de especialistas que trabajen paralelamente, en los diferentes acuíferos transfronterizos.
En estos grupos deben participar profesionales de ambos países con diferentes formaciones académicas, incluyendo: ingenieros, geólogos, hidrogeólogos, investigadores, abogados, sociólogos y economistas.
La GOBERNANZA del agua requiere tener un MARCO INSTITUCIONAL CON LIDERAZGO.
CILA, IBWC, CONAGUA y sus contrapartes en Estados Unidos, deben organizar y vigilar la operación de los grupos de trabajo, en los cuales deben estar incluidos: Universidades, Asociaciones Gremiales, Organizaciones no Gubernamentales, entre otros grupos relevantes.

Water governance requires a deep knowledge of transboundary aquifers and their diffusion to create awareness.
This implies forming groups of specialists working in parallel in the different transboundary aquifers.
These groups should include professionals from both countries with different academic backgrounds, including: Engineers, geologists, hydrogeologists, researchers, lawyers, sociologists, and economists.
Water governance requires to have an institutional framework with leadership.
CILA, IBWC, CONAGUA and their counterparts in the United States must organize and monitor the operation of the working groups, which must include: Universities, Professional Associations, Non-Governmental Organizations, among other relevant groups.

La GOBERNANZA del agua requiere establecer POLÍTICAS HÍDRICAS CONSISTENTES, INCENTIVOS Y
PLANIFICACIÓN a corto, mediano y largo plazo.
Las políticas hídricas deben considerar la investigación conjunta para conocer con detalle la situación en que se encuentran los acuíferos a uno y otro lado de la frontera.
Establecer los recursos hídricos disponibles y como se deben de utilizar, lo cual debe quedar asentado en Actas binacionales.
Esto permitirá asegurar que los recursos hídricos subterráneos binacionales serán usados de forma sustentable y que serán protegidos en ambos lados de la frontera de actividades que los puedan disminuir en cantidad y calidad.
Esto incluye la protección a los recursos hídricos superficiales que pueden estar conectados con los acuíferos.
Water governance requires the establishment of consistent water policies, incentives, and planning on the short, medium, and long term.
Water policies should consider joint research in order to know in detail the status of the aquifers on either side of the border.
Binational minutes of meetings should establish the available water resources and how they should be used.
This will ensure that binational groundwater resources will be used sustainably, and that both sides of the border will protect them from activities that can decrease the quantity and quality of water.
This includes the protection of surface water resources that may be connected to aquifers.

La GOBERNANZA del agua requiere establecerINCENTIVOS Y PLANIFICACIÓN a corto, mediano y largo plazo.
Estos incentivos deben estar dirigidos a los usuarios del agua de forma que favorezca el uso eficiente, el reúso, la recarga de acuíferos, entre otras actividades que deberán ser evaluadas de acuerdo al tipo de usuarios de agua subterránea en cada acuífero.
Mejorar la eficiencia de los organismos operadores de agua.
Reúso de agua residual tratada.
Reúso de agua de retorno agrícola.
Dar incentivos a los organismos operadores para inviertan en la recarga de acuíferos.
Todo esto en conjunto lleva a la planificación en la administración, manejo y uso del agua subterránea.
Water governance requires the establishment of incentives and planning on the short, medium, and long term.
These incentives should be aimed at water consumers, in a way that favors the efficient use, reuse, and recharge of aquifers, among other activities that should be evaluated according to the type of groundwater consumers in each aquifer.
Improve the efficiency of water agencies.
Reuse of treated wastewater.
Reuse of waste agricultural water.
Give incentives to water agencies so that they invest in the recharge of aquifers.
All this together leads to planning in the administration, management and use of groundwater.

PROPUESTA:
o Para evitar las grandes diferencias en capacidad de financiamiento y organización de las instituciones se propone que se realicen acuerdos binacionales a través de actas de la CILA/IBWC para trabajar en conjunto todos los acuíferos transfronterizos.
o Se debe unificar la delimitación de acuíferos.
o En los estudios deben participar profesionales de ambos países con diversas formaciones académicas.
o Se debe establecer la solución a corto y mediano plazo de los problemas detectados.
o La información generada debe estar disponible a toda la sociedad.
PROPOSAL:
o In order to avoid large differences in the
financing capacity and organization of the
institutions, binational agreements should be
made through IBWC/IBWC minutes, so as to work
in conjunction all the transboundary aquifers.
o Demarcation of aquifers must be unified.
o Professionals with different academic
backgrounds and from both countries and with
should participate in any studies carried out.
o A solution must be established on the short and
medium term of the problems detected.
o The information generated must be available to
the whole society.

PROPUESTA:
o Las soluciones deben instrumentarse legalmente.
o Se debe dar seguimiento a las acciones propuestas para asegurar que los recursos hídricos subterráneos y superficiales transfronterizos se conserven en cantidad y calidad.
o Como alternativa de solución relevante se debe trabajar en:
o El uso eficiente del agua, o El reúso del agua,o El uso del agua residual tratada, o La recarga de acuíferos, o El uso del agua de retornos agrícolas, o La desalación del agua salobre contenida
en algunas de las formaciones geológicas de las zonas fronterizas, y
o En establecer incentivos para que los organismos operadores de agua inviertan en estas soluciones.
PROPOSAL:
o The solutions must be legally implemented.
o The proposed actions must be followed up to ensure that transboundary groundwater and surface water resources are conserved in quantity and quality.
o As an alternative important solution, we have to work on:
o Efficient use of water,o Reuse of water,o Use of treated residual water,o Recharge of aquifers,o Reuse of waste agricultural water,o Desalination of brackish water contained
in some of the geological formations, ando Give incentives for water agencies to
invest in these solutions.

¿Cómo se debe entender una distribución equitativa del agua disponible entre los países que comparten el AT?
En forma proporcional:
¿A la extensión superficial que corresponde a cada país?
¿A la recarga natural que tiene lugar en cada uno?
¿A la magnitud de su demanda de agua?
¿Tiene más derecho el país que inició antes la explotación de su porción del AT? (¿Primero en tiempo, primero en derecho?)
¿Cómo conciliar los marcos legales de los países que comparten el AT?
WHAT CRITERIA SHOULD WE USE TO SHARE THE PIE:

RECOMENDACIONES:
o Mejorar el programa de colaboración
binacional en materia de acuíferos
compartidos.
o Seleccionar de común acuerdo los AT a
continuar estudiando.
o Jerarquizar considerando la importancia
relativa del agua subterránea en ambos
países.
o Establecer modalidades de colaboración más
ágiles en la ejecución de las actividades.
o Dar apoyo a las dependencias responsables.
RECOMMENDATIONS:
o Improve the binational collaboration program
on shared aquifers.
o Select by agreement the TA to continue
studying.
o Hierarchize considering the relative
importance of groundwater in both countries.
o Establish more agile collaboration modalities
in the execution of activities.
o Support to the responsible agencies of
government.

RECOMENDACIONES:
o Evitar la precisión innecesaria, costosa y que
retarda los resultados.
o Hacer compatibles los instrumentos legales
existentes en los que se manejen
conjuntamente las aguas superficiales y
subterráneas.
o Diseñar o rediseñar los sistemas de monitoreo
conjunto de aguas subterráneas y
superficiales.
o Detectar oportunamente los efectos
transfronterizos adversos.
o Dar seguimiento a las acciones de manejo
conjunto que se implanten.
RECOMMENDATIONS:
o Avoid unnecessary precision, because it is
expensive and delays the results.
o Make the existing legal instruments to
conjointly manage surface and groundwater
compatible to both countries.
o Design or redesign the joint monitoring systems
of ground and surface water.
o Work on the timely detection of adverse
transboundary effects.
o Follow up the joint management actions that
are implemented.
